CYBERSIST TERM OF SERVICE AGREEMENT

SERVICE DESCRIPTION
Cybersist is a online Personal Information Management (PIM) system which provides all types of services (the "Service") for your personal needs. By using Cybersist you agree to be bound by these Terms of Service (this "Agreement"). The Terms of Service may be updated by us from time to time without notice to you. You may review the most current version of this agreement here

You understand and agree that the Service is provided "AS-IS" and that Cybersist assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.

There are two types of memberships available on Cybersist. Basic members are free and have access to almost all set of features in Cybersist and a 4MB storage space. Premium membership are available for an annual fee and have access to all of the Basic membership features as well as additional features and a 20MB storage space. You agree that we may change the types of membership that are available on Cybersist or the features associated with them at any time.

REGISTRATION
In consideration of your use of Service, You must be 13 or over to register as a member of Cybersist or use the Web site. You must also agree to provide true, accurate and current information about yourself as prompted by the registration form. If you provide any information that is untrue, inaccurate, not current or incomplete, suspected that such information is untrue, inaccurate, not current or incomplete, Cybersist has the right to terminate your account and refuse any and all current or future use of the Service.

MEMBER ACCOUNT, PASSWORD, AND SECURITY
You are responsible for maintaining the confidentiality of your password and account, and are fully responsible for all activities that occur under your account. You may not use anyone else's account at any time, without the permission of the account holder. It is advisable that you Sign out at the end of each session. Cybersist will not be liable for any unauthorized usage of your account.

NON-COMMERCIAL USE
Unless otherwise specified, the Cybersist services are for your personal and non-commercial use. Organizations, companies, and/or businesses may not become Members and should not use the our services. Collecting usernames and/or email addresses of members by electronic or other means for the purpose of sending unsolicited email is stricly prohibited.

USE OF SERVICES
You agree that Cybersist may review and delete any data, content, messages, photos, videos, musics, software or other materials (collectively, "Content") which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of Members.

You are solely responsible for the Content that you publish or display on the Service, or transmit to other Members.

Partial list of illegal or prohibited Content is as follow:
1) Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.
2) Transmission of "junk mail", "chain letters," or "spamming";
3) Content that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party.
4) Content that contain viruses, Trojan horses, worms, or any other similar programs that may damage the operation of another's computer or property of another.
5) Content that displays pornographic or sexually explicit material of any kind.

INDEMNITY
You agree to indemnify and hold Cybersist, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Service in violation of this agreement and/or arising from a breach of this agreement and/or any violation of any rights of another.

DISCLAIMERS
1)Cybersist is not responsible for any incorrect or inaccurate Content posted on the Web site.
2)Cybersist assumes no responsibility for any error, interruption, deletion, defect, delay in operation or transmission in the Service.
3)Any material downloaded or obtained through the Service is done at your own risk and you are responsible for any damage to your computer system.
4)Cybersist will not be responsible for any loss or damage, including personal injury or death, resulting from anyone's use of the Service or any interactions between users of the Web site.
5)The Service may be temporarily unavailable from time to time for maintenance or other reasons.
